Darmanin Plus App Terms and Conditions

Darmanin Plus is operated by Darmanin Footwear Limited

Please read these terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Darmanin Footwear Ltd, makes the Darmanin Plus app available to you. 

Terms & Conditions

These Terms & Conditions govern the collection and use of points and set out the terms of the contract between Darmanin Plus (“us/we”) and each Member. As a Member, you can start collecting points by making qualifying purchases at any of the Participating Outlets when showing proof of membership with the Darmanin Plus App (the ‘App’). If you register with Darmanin Plus and use the App in any of the Participating Outlets you automatically accept these Terms & Conditions which are subject to changes at any time. We reserve the right to verify the individual’s eligibility to Darmanin Plus and may refuse an application for any good reason.

The individual must be at least [16] years old to qualify for a Darmanin Plus account. The individual is responsible for age self-certification and giving incorrect information may lead to the termination of the membership.
The Member is responsible to update any personal information if changes arise. The Member is also responsible to ensure the Darmanin Plus password is kept in a safe and secure location at all times. Darmanin Plus will not be liable for any unlawful or misuse of the Member’s Darmanin Plus account.

SIGNING UP TO DARMANIN PLUS

Signing up to Darmanin Plus is free. Customers can sign up to Darmanin Plus by downloading the App via GooglePlay or the Apple Store and register.

POINTS

The Member has instant access to his/her points collected or redeemed by accessing the account via the Darmanin Plus App.
Points expiry – 24 months.
Points are lost if the relevant Darmanin Plus Account is closed by the customer by unsubscribing or the Darmanin Plus programme ends. If the Darmanin Plus app will be terminated, Darmanin Footwear Ltd. will be advising customers via email at least 3 months prior to the termination for the Customer to be able to redeem any pending balance of points in their account. During these 3 months, no points will be issued by the Participating Outlets.
Points can only be earned, held, transferred or redeemed as set out in the Terms & Conditions. Any points not earned and held in accordance with these Terms & Conditions will be invalid and cannot be redeemed. Any such points on a Darmanin Plus Account will be deducted and, if they are redeemed, we will ask the Participating Outlet to cancel the relevant transaction and we may take other appropriate action.
Darmanin Plus reserves the right to modify the way in which points are earned and redeemed, including the number of points earned and the value of these points.
Points are personal to a Darmanin Plus Account and cannot be combined to redeem on a joint purchase.
We will only be liable to a Member who suffers loss as a result of our breach of these Terms & Conditions and, if so, our sole liability will be to credit to the relevant Darmanin Plus Account any points which have been wrongly deducted or should have been credited but were not.
The processing time of points issued/redeemed may vary between the Participating Outlets. Points earned will be available for redemption within a 10 minute period from the transaction time. We are not responsible for any limitations of the Internet or technical malfunctions of any communications network, online system or computer hardware or software that may affect the transaction of points.
We will correct a Darmanin Plus Account if it is shown to our reasonable satisfaction to be wrong but, unless there are clear records showing this, our decision is final.

COLLECTING DARMANIN PLUS POINTS
To begin collecting points you must have the Darmanin Plus app. If you don’t already have one, please refer to the ‘Signing up to Darmanin Plus’ guide on www.darmaningroup.com
For every €1 spent, you will receive 5 points. Every 100 points accumulated can be redeemed for €1 from any of our stores.
We will round up or down the cents portion of your purchase as follows:

  • If you spend €xx.50 or more, this will be rounded up
  • If you spend €xx.49 or less, this will be rounded down

Darmanin Plus points are collected on the total value of purchase, including VAT, but excluding any legal duty. In the case of purchased vouchers, Darmanin Plus points are only applicable upon purchasing, not on redemption of vouchers. Darmanin Plus points will not be awarded for online orders.
In exceptional circumstances, customers have a period of 5 days from the date of purchase to provide their receipt to obtain points for their purchase. Customers can send an email to info@darmaningroup.com.mt. Customers need to submit a clear photo and/or the FULL receipt. It is the responsibility of the customer to keep the physical receipt until points are visible in their account as a re-confirmation of certain details may be requested by the Darmanin Plus team. The scheme is not held responsible of the inability to add points to the customers account further to insufficient information provided via the full receipt.
When a gift voucher is purchased from one of the Participating Outlets, the allocation of points will be awarded to the member redeeming the gift voucher.
In certain periods or events, the Participating Outlets may offer Members bonus points. There is no cash alternative and the offer is not transferable. Darmanin Footwear Ltd reserves the right to change or cancel any bonus offer promotions at any time.

REDEEMING DARMANIN PLUS POINTS
Members can redeem any points that they have collected at any of the Participating Outlets upon presentation of their Darmanin Plus App. If a Member does not redeem the entire value of his/her points, the balance value will remain in the Member’s account and can be used towards future transactions. Points can be redeemed in round values eg €1, €2, etc.
Presentation of ID card may also be requested as a security measure. Redemption of points can be made on any transaction, the value of which exceeds the points balance in the Member account. Points are not earned on the redeemed value.
Darmanin Plus Points available for redemption cannot be exchanged for cash. If the value of the purchase is more than the value of the Darmanin Plus points the balance amount must be paid by the Member using a valid payment method.
Points cannot be redeemed until credited to a Darmanin Plus Account.
If a transaction on which points are issued or redeemed is cancelled, reversed or not completed, we will reverse the associated points movement.
If we suspect fraud or misconduct, redemption may be refused or cancelled.

RETURNS
Returns will only be accepted upon presentation of the purchase fiscal receipt.
In the case of a return, the Points will be reversed in the system. If a credit note is provided to the Member, points will temporarily be reversed and will be re-issued upon usage of the credit note in a future purchase.

DEPOSITS
No points will be issued when a Member places a deposit on a purchase. Instead, the full points value will be issued as and when the purchase has been completed, and the invoice has been settled within 7 working days.
A Member may choose to redeem their points as part of a deposit when placing the order. However, no points can be redeemed at the point of delivery.

PROMO CODES/ QR CODES
Individuals who are found to be abusing of the Promo Codes or QR codes provided when registering with Darmanin Plus will be notified and account will be suspended. It is not allowed to create multiple accounts with the provided Promo Code or QR Code, then sending points to the main account/s of the individual.

UNSUBSCRIBING
You may cancel your membership at any time by sending us an email to info@darmaningroup.com.mt or by unsubscribing through the App following these steps: Menu > Profile > Deactivate Account. If a Darmanin Plus account is closed, the Member’s rights to redeem points from that Darmanin Plus account are lost and cannot be reclaimed.
With reference to marketing communication, you can withdraw your consent from marketing information at any time by sending us an email to info@darmaningroup.com.mt, by clicking unsubscribe on any email you receive from us or by unticking this option from the App by going to Menu > Profile.

MEMBER INACTIVITY
If a Member has a balance of zero points, or only the signup bonus points, and has been inactive for 2 years or more, Darmanin Footwear Ltd reserves the right to remove this Member from the database. Members who have a balance of points greater than the signup bonus points in their account will not be immediately deleted from the Darmanin Plus database but may have their account suspended. If a suspended account remains inactive for another year, it may then be deleted unless reclaimed or reactivated.

GENERAL
Darmanin Plus is only available in Malta and shall be governed by the laws of the country. Points can only be collected or redeemed locally and in one of our physical outlets.
We may make changes to these Terms & Conditions and also reserve the right to add or remove any of the Participating Outlets.  We strive to keep our Members up to date with any changes in the scheme and will give the Member as much notice as we reasonably can. Earning or redeeming points on a Darmanin Plus account will constitute acceptance of the revised Terms & Conditions.
We may suspend or terminate Darmanin Plus but will give as much notice as we reasonably can before we do so. If this happens all Darmanin Plus Accounts will be suspended or terminated. If we sell or transfer Darmanin Plus to another company we may transfer all of our rights and obligations under these Terms & Conditions without any further consent and may disclose or transfer all information we hold about the Members to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Member in respect of the use that can be made of such information by such other company.
We may use third parties to facilitate one or more elements of Darmanin Plus. We may also partner with new providers of good or services which may form part of the Participating Outlets. These third party service providers/partners are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced related operation.
While Darmanin Plus will endeavour to ensure that the services, benefits, facilities and arrangements as expressed or advertised by Darmanin Plus and the Participating Outlets will be available to the Members, Darmanin Plus will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, whether whole or part, of any such services, benefits, facilities or arrangements.
These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
We may, on notifying the Member, immediately suspend or terminate their rights, refuse to award Points, withdraw Points, refuse the right to redeem Points collected and/or close any relevant Darmanin Plus Account, if they breach these Terms & Conditions, if we reasonably believe that they have dealt with points in a manner not permitted by these Terms & Conditions or any applicable Participating Outlet’s terms and conditions, if there is any theft from or misconduct in connection with us or one of the Participating Outlet, if they supply false or misleading information to us or if they are abusive or offensive to any member of our staff.
We reserve the right to suspend, change or cancel the Darmanin Plus loyalty programme as well as the Terms & Conditions at any point in time, in the event of circumstances arising which in Darmanin Footwear Ltd’s opinion make it necessary for it to do so.
