Darmanin Footwear Limited (C6082) (“Darmanin Group”) strongly values the privacy of its clients and is committed to protect your personal data (i.e. information that identifies you)

One of your rights under EU law – the GDPR – is that you must be informed when your personal data – also known as personal information – is processed (collected, used, stored) by any organisation. You also have the right to know the details and purpose of that processing.

This privacy policy describes our practices related to the processing of personal data, including that relating to the personal data of Loyalty scheme cardholders who have registered with us to obtain their Darmanin Group Loyalty Card for Darmanin Footwear, Teamsport and Gallarija Darmanin.

We assure you that we will only use and disclose any personal data collected from you in accordance with the manner set out in this policy.

► Information we collect

Most of the personal information which we collect about you is collected through our registration form or process which you need to fill in order for us to provide you with your Loyalty Card, which card allows you to enjoy our special offers, discounts and member offers. This personal information will be requested when you fill in the registration form physically at one of our outlets.

If you send us emails, then the personal data we process will depend on what you send us via email.

The information we collect from you normally includes the following:

► How & Why we use your information

We use the above mentioned personal data we collect from you to keep a database of loyal customers and to get in touch with you via mail, email or sms to inform you of our special offers and discounts available at our stores.

We do this because we need your personal details to provide you with your Loyalty Card and to inform you of our special offers and discounts which you are entitled to as a Loyalty Scheme cardholder.

If you want to unsubscribe from receiving more information about our discounts, special offers or marketing, or if you want us to completely remove all your information from our loyalty scheme database please send us an email on info@darmaningroup.com.

You don’t have to give us any of this personal information but if you don’t, you will not be issued with a Loyalty Card and will not benefit from our special offers and discounts.

The Legal Basis for Processing

For some of the uses of your personal data (as described above) there is a legal basis under applicable data protection laws for us to use such personal data without having obtained your consent.

This includes, for example, where it is necessary for us to use the information to perform a contract with you.

In some circumstances (such as we have described below) we have a legitimate interest to use your data, provided that proper care is taken in relation to your rights and interests:

(i) to ensure that you know about any changes to the terms of this Privacy Policy. (ii) to ensure that we organise our databases efficiently and understand how our

clients may make purchases; (iii) to carry out research and analysis of your data (including purchase information) as this helps us understand our clients better, who they are and how they interact with us;

Retention Periods

  • We will hold on to your information for no longer than is necessary keeping in mind the purpose/s (or compatible purposes) for which we first collected the data.
  • We may also keep hold of some of your information if it becomes necessary or required to meet legal or regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our terms and conditions.
  • As a guide:

– we will usually keep your personal data while your Loyalty Card is still active with us or until when you ask us to remove you completely from our Loyalty Scheme database, unless there are valid or legal reasons for us to keep the data for longer;

– we may keep certain categories of personal data for longer in order to meet any

legal or regulatory requirements, or to resolve a legal dispute;

► Children Under 16

If you are aged 16 or under, please get your parent/guardian’s permission before you provide any personal information to us.

We will need to process personal data relating to parents or guardians in that case – and we may also need to request for verification documentation to ensure that consent is given or authorised by the holder of parental responsibility.

► Sharing your information

We will not, sell any of your personal data to any third party

However, we share your data with the following categories of companies as an essential part of being able to provide our services to you, as set out in this statement:

  1. Companies in the group to which Darmanin Group belongs, related entities and subsidiaries use the information collected to better understand our customers and markets; and to improve our products and services. Members of the group vary from time to time.
  2. Professional service providers, such as marketing agencies, advertising

partners and website hosts who service us in turn to operate our business.

► Marketing Messages

As part of our Loyalty Scheme we normally communicate to you about products or services in which you have shown interest or which you are already buying from us – we understand that you would be interested in receiving this information as it is of use with the product or service. But rest assured, you can ask us to stop whenever you want by hitting the “unsubscribe” button.

You can stop receiving marketing messages from us at any time through any of the following methods:

Once you do this, we will update your profile to ensure that you don’t receive further marketing messages.

► Your rights

You enjoy several rights relating to your personal information:

(i) The right to be informed about how your personal information is being used;

We need to be clear with you about how we process your personal data. We do this through this Privacy Policy, which we will keep as up to date as possible.

(ii) The right to access the personal information we hold about you;

To process your request, we will ask you to send us proof of identity so that we can be sure we are releasing your personal data to you and not someone else.

We will carry out our best efforts to process your request within one month or, if the request is particularly complex, two months. We can provide you with a copy of your personal data in electronic format or hard copy.

If we consider the frequency or nature of your requests as excessive or unreasonable, we may refuse to comply with your request. In those circumstances, if you disagree, you can complain to the data protection authority – in Malta, the Information and Data Protection Commissioner.

(iii) The right to request the correction of inaccurate personal information we hold about

you;

We want to ensure that our records and data are accurate and up-to-date.

(iv) The right to request that we delete your data, or stop processing it or collecting it;

You have a right to ask us to delete your personal data; however, this is not an absolute right.

In spite of a request for erasure, we may be justified to keep personal data which we need to keep, e.g. (i) to comply with a legal obligation or in the exercise or defence of any legal claims.

When you ask us to delete your personal data, we assume that you do not want to hear from us again. To ensure that we do not send you any special offers in the future we will keep just enough of your personal data solely for suppression purposes.

Other than as described above, we will always comply with your request and do so promptly.

(v) The right to stop direct marketing messages;

Please appreciate that the rights must be exercised within some limitation – for example, if you ask us for information we can only give you what relates to you and not what relates to other persons. When we receive requests, we may also request that you identify yourself and provide documentation or information for verification (we would not want to disclose information to the wrong person). Unreasonable requests may be subjected to a reasonable fee or refusal to respond.

We do our best to keep the information you disclose to us secure. However, we can’t guarantee or warrant the security of any information which you send to us.

Darmanin Group is the trading name for our operations which are directed by Darmanin Footwear Ltd having registered address at Gallarija Darmanin, Dun Karm Street, Iklin. Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

Kindly note that information relating to a legal person (for example, a company or legal entity) does not amount to personal data in terms of applicable data protection and privacy law. In that regard, the definition of personal is strictly limited to information which relates to a natural person.

 

On this basis, the collection and use of information such as a company name, its company number, registered office and VAT number (i.e. “Company Information”), does not amount to the processing of personal data and, in turn, does not give rise to data controller obligations and data subject rights. Where collected, we will naturally still treat and handle such Company Information in an appropriately confidential and secure manner. This is particularly relevant to those of our customers which are businesses (i.e. where the relationship with Darmanin Group constitutes a business-to-business (B2B) relationship).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with a product or service that you have requested). You can ask us (i.e. Darmanin Group) or third parties to stop sending you marketing messages at any time by:

Where you opt out of receiving these marketing communications, this will not apply to personal data provided to us as a result of your account registration, orders or purchases, any service provision to you, your feedback and survey responses, or other transactions.

Change of Purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

Please note that we may process your personal data without the need for obtaining your consent, in compliance with the above rules, where this is required or permitted by law.

  1. Disclosures of your personal data

We may have to share your personal data with the parties set out below for the purposes set out in the table in paragraph 4 above.

  • External Third Parties, in particular the companies which we engage in order to provide the services, in particular MailChimp and Campaign Monitor Pty Ltd. These entities act as processors and we have contractual agreements in place in order to ensure that any processing of personal data is carried out in accordance with applicable data protection laws and that your privacy rights are respected.

We may also transfer your personal data to professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

In compliance with our legal obligations we may need to transfer personal data to regulatory authorities and governmental authorities, in particular the Commissioner of Inland Revenue, regulators and others based in Malta, who require reporting of our processing activities in certain circumstances.

 

  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

We may also disclose your data if we are under a duty to disclose or share your personal data to comply with any legal obligation, judgment or an order from a court, tribunal or authority.

We may also disclose your data to enforce our contractual terms with you, or to protect our rights, property or safety. This includes exchanging information with other companies, organisations, law enforcement agencies for the purposes of fraud protection and the detection, prevention and investigation of crime.

  1. International transfers

Generally, we do not transfer your personal data to outside the European Economic Area (“EEA”) except as may be necessary for any contract you have or wish to enter into with us (e.g. for products or services you have requested or ordered from us). Where we do need to transfer your personal data to outside the EEA (whether for the above purpose or for a different purpose), we will ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards applies:

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

 

Furthermore, we have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long will you use my personal data for?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By and large, our retention of your personal data shall not exceed the period of five (5) years from the conclusion or termination of your contractual relationship with us. This period of retention enables us to use your data for the assertion or defence of possible future legal claims (taking into account applicable statutes of limitation and prescriptive periods). In certain cases, we may need to retain your personal data for a period of up to ten (10) years in order to comply with applicable accounting and tax laws (this will primarily consist of your Transaction Data).

In other circumstances, we may also anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

  • You have the right to:
  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • You may send an email to ilona@darmaningroup.com requesting information as to the personal data which we process. You shall receive one copy free of charge via email of the personal data which is undergoing processing. Any further copies of the information processed shall incur a charge of €5.
  • Right to information when collecting and processing personal data about you from publicly accessible or third party sources. When this takes place, we will inform you, within a reasonable timeframe, about the third party or publicly accessible source from which we have collected your personal data.
  • Request correction or rectification of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected and/or updated, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where:
  • there is no good reason for us continuing to process it;
  • you have successfully exercised your right to object to processing (see below);
  • we may have processed your information unlawfully; or
  • we are required to erase your personal data to comply with local law.
